以下是我们公司《考勤管理规定》中对加班的具体规定。由于大部分部门实行综合计算工时制,法定节假日的加班我们是支付300%工资的,其他时间的加班则安排倒休。如果员工离职时仍有倒休未休完,部门详细列出公休日、工作日延时的不同情况,离职结算时,按照200%和150%分别结算。
五、超时工作与倒休
Overtime and Compensation Day-off
1、 超时工作
Overtime
1) 加班/加点定义:确因工作需要或特殊原因要求员工在公休日或法定节假日期间从事工作的是加班;在标准工作日的工作时间以外连续从事工作的是加点。
Definitions: PH Duty & Overtime/ Overtime
PH Duty: Work on weekends or Public Holidays as required by business and/or other special requirements.
Overtime: Extended working hours after scheduled shift in regular working days.
2) 不属加班加点范围
Exceptions
A. 未履行加班审批手续的情形。
The failure of application of PH Duty and/or Overtime in advance.
B. 非酒店安排加班加点。
The PH Duty and/or Overtime are not scheduled by Swissôtel Beijing.
3) 加班加点审批手续
PH Duty/Overtime Approval Procedure
A. 法定节假日加班,部门应至少提前7天填写《法定节假日计划加班申请表》,写明加班原因、地点、时间和人员,经部门负责人签字后,于加班前7天呈报人力资源部和财务部审核。经人力资源部和财务部批准后,方可安排加班工作。
For PH Duties, the department head is required to submit the application to HR and Accounting for approval at least 7 days in advance, with the information of the reason, location, date/time and number of employee required. The PH Duty roster will only takes effect upon the final approval from HR and Accounting.
B. 公休日加班或工作日延长工作时间(加点),由部门负责人批准。部门秘书负责在人力资源系统中录入加班加点原因、地点和员工加班加点后经部门主管或经理确认的加班加点实际时间,部门管理人员(根据权限)负责审批录入人力资源系统的数据和纸质申请表,并将纸质的申请表呈报人力资源部备案。
The regular overtime is to be approved by the respective department head. Departmental secretary responsible for inputting the information of the reason, location, and the actual working hours (acknowledged by supervisor or manager) into HR system. Departmental management is responsible for approving the HR system data inputted as well as the hard copy application. The hard copy application to be submitted to HR for filing purpose.
C. 在法定节假日遇有紧急抢修任务等情形,来不及事前履行加班审批手续的,部门负责人要以电话的形式通知人力资源部,并说明原因方可视为加班。但事后应及时(24小时内)补办审批手续。
In the event of emergency repairs and such on Public Holidays, the department head shall inform HR via telephone with proper explanation. The application shall be done within 24hours then.
4) 加班加点小时数:因工作特殊需要且经过协商,一般每日最多不超3小时,每月最多不超36小时。自然灾害、意外事故、排除故障、重大活动以及法律法规规定的其他情形除外。
The ceiling of overtime hours: in general, maximum 3 hours per day and 36 hours per month. Except for the following circumstances: Natural disasters, accidents, troubleshooting, special events and other circumstances stipulated by laws.
2、 倒休
Compensation Day off
1) 员工加班加点,部门应履行相关手续详细记录加班加点的时间,并安排员工倒休。员工倒休均应填写《外出、倒休、班次变更批准表》。《外出、倒休、班次变更批准表》一式两联,部门应将其中一联交人力资源部备案。
The department shall make detailed record in terms of actual working hours for those who had overtime, and the compensation day off to be arranged accordingly. The Compensation Day-off Slip to be filled out prior to taking the days off, and one copy of the Slip to be submitted to HR for filling purpose.
2) 员工倒休后,部门秘书应及时在人力资源系统里记录倒休的时间,并冲减因加班加点产生的存休。
After the compensation day off being taken, the departmental secretary shall update the record in HR System accordingly.
3) 员工倒休应由部门在加班加点产生的半年内予以安排。对确因工作需要无法安排倒休的,部门经理需书面申请,经人力资源部审核呈报总经理批准,可以顺延。但最迟要在当年内予以安排。倒休不允许跨年度使用,过期未安排的视为自动放弃。
Compensation day off should be cleared within the following half year of the overtime. In the case that the compensation day off cannot be arranged thanks to the business requirement, the written application of postpone should be raised by the respective department head to HR, and the application to be submitted by to HR to General Manager for final approval. Nevertheless, the compensation day off should be cleared within the calendar year after all. Otherwise, the outstanding compensation day off would be waived automatically.
4) 员工离职前尚有加班未能安排倒休,酒店在员工办理离店手续时,按计算加班工资的基数和规定的比例支付加班工资。
In case of the outstanding compensation day off were not able to clear off before employees last working day, the compensation day off are to be paid based on the basic salary and specific ratio.
5) 严禁以倒休顶替迟到、早退。
It is strictly prohibited to replace the time of being late/leaving work early with the compensation day off.
